How does the IMMEX Program work?
This program allows you to temporarily import goods used in an industrial or service process intended for the production, transformation or repair of merchandise of foreign origin for export or for the presentation of export services.
How is it authorized?
The Ministry of Economy (SE) may authorize legal entities residing in national territory that are taxed in accordance with title II of the ISR law, a single program, which may include the modalities:
- Holding company: In the same program, the manufacturing operations of a certified company called holding company and some other holding companies are integrated.
- Industrial: An industrial process is carried out, the elaboration or transformation of merchandise destined for export.
- Services: Services are provided to export merchandise or export services are provided, solely for the development of the activities that the Ministry of Economy (SE) determines, with the prior opinion of the Ministry of Finance and Public Credit (SHCP).
Shelter: One or several foreign companies provide technology and production material, without the latter operating directly from the Program.
Outsourcing: A certified company that does not have facilities to carry out production processes carries out manufacturing operations through third parties that it registers in its program.
What are the benefits of the program?
The purpose of the IMMEX Decree is to promote and grant facilities to manufacturing, maquiladora and export service companies, such as:
- Allow the temporary importation of merchandise of foreign origin intended for manufacturing, transformation or repair processes for export or for the provision of export services.
- Automatic registration in the list of importers.
- Transfer merchandise temporarily imported under its IMMEX program to other companies with an IMMEX program, to IAT or MVA companies, or to persons who have authorization to send merchandise to the RFE.
- Preferential rates or quotas on the Customs Processing Fee (DTA).
- Companies in the auto parts industry could transfer parts and components temporarily imported under their IMMEX program to IAT or MVA companies, for their vehicle assembly and manufacturing processes.
- Preferential Rates related to the determination of and payment of tariffs on temporary import merchandise.
- Simultaneous authorization of a Sectoral Promotion Program (PROSEC), according to the type of products that it manufactures or the export services that the company performs.
The IMMEX program will be in force, provided that the holder complies with the requirements established for its authorization and with the obligations established in the Decree itself.
